Terms of use
Short, because the important parts are short. Please read them before you buy.
Agreement to these terms
By using this website, checking a property, or purchasing a package, you agree to these Terms of Use and to our Privacy Policy. If you do not agree, do not use the service. Before a package downloads you are asked to confirm, in writing that we record with the date: “I have reviewed every figure in this package and confirm it is accurate to the best of my knowledge. I agree to the Terms of Use and the Privacy Policy.”
Philly Appeal is a sole proprietorship operating in Pennsylvania. In these terms “we”, “us” and “Philly Appeal” mean that business.
Who may use it
You must be at least 18 years old and able to enter a contract. By entering figures for a property you represent that you own it, or that you are authorised to act for the person who does.
What this service is
Philly Appeal is document-preparation software. It takes figures you supply, performs an income capitalization calculation on them, and produces a completed Board of Revision of Taxes appeal package as a PDF for you to print, sign and file.
What it is not
Philly Appeal is not a law firm and does not provide legal, tax, or appraisal advice. We prepare documents from figures you supply and do not file, submit, or present your appeal, and we do not represent you before the city’s Board of Revision of Taxes. The value shown is arithmetic on your own numbers, not a licensed appraisal. You are responsible for the accuracy of your information and for filing on time.
In particular: we are not a law firm and give no legal advice; we are not accountants and give no tax advice; and the value the software produces is not an appraisal. No licensed appraiser has reviewed it. It is arithmetic applied to numbers you entered, including a capitalization rate you chose.
We do not file anything
Philly Appeal does not file, submit, or present your appeal, and does not represent you before the city’s Board of Revision of Taxes. You file the package yourself. Check every figure before you do.
We do not submit your appeal, do not appear before the city, do not represent you, and are not your agent for any purpose. Delivering the package to the Board of Revision of Taxes, and doing so before the deadline the city sets, is entirely your responsibility.
What you are responsible for
- The accuracy of every figure you enter, and of every figure on the finished package. Before it downloads you confirm: “I have reviewed every figure in this package and confirm it is accurate to the best of my knowledge. I agree to the Terms of Use and the Privacy Policy.” We record that you did.
- Choosing a capitalization rate you can stand behind. The software supplies no default and offers no opinion on what yours should be.
- Filing on time, in the manner the city requires.
- Your signature, if you choose to add one here. The software supplies a drawing area; the mark is one you make, and placing it on the form is you making the affirmation printed above that line: “Through my signature below, I affirm that I am the owner or the appointed representative of the owner and that all of the information supplied is true and accurate to the best of my knowledge.” You can decline and sign the printed package by hand instead, and whether the Board of Revision of Taxes accepts a signature made this way is the city’s decision rather than ours.
- Deciding whether to appeal at all. The city may raise, lower, or leave your assessment unchanged, and we make no prediction about which.
The city’s own records
Lot size, improvement area, zoning and assessment figures are read from the City of Philadelphia’s public records and passed through to you as published. We do not independently verify them and do not guarantee that they are accurate, complete or current. They are shown to you before they are used, and every one of them is editable, because you are better placed than we are to know when the city is wrong about your building. Check them against your own records and your notice before you file.
No guarantee of any outcome
Nothing on this site is a promise that your assessment will be reduced, that your appeal will succeed, or that you will save any particular amount. Any figure the software shows as an estimate is arithmetic on your own inputs, not a forecast. We charge no percentage of any reduction and no contingency fee, so we have no stake in what you claim.
Where we operate
Philadelphia County only. The Board of Revision of Taxes has jurisdiction over property in Philadelphia and nowhere else, and the software will tell you if the address you enter appears to be outside it.
Using the service properly
- Enter figures for property you own or are authorised to act for. Do not enter someone else’s information.
- Do not attempt to reach appeals that are not yours.
- Do not use automated means to place load on the service, or on the city’s public records endpoint through it.
We may suspend access that breaks these rules or that threatens the service’s availability for other people.
Cost
Checking whether your property is over-assessed is free. A complete appeal package is $49, charged once per property per tax year and payable before you download it. Every figure that will appear on the forms is shown to you first, so you are not paying to find out what you are buying.
Refunds and cancellation
You can see every figure before you pay. The check is free, and the price appears before checkout rather than at it, so nothing about the package should be a surprise by the time you reach the payment page.
- Before you download. Paid and changed your mind, or found a mistake in your own figures? Write to us and we will refund you in full.
- After you download, if the package is wrong. If a figure on the finished package does not match what you entered, or a page is missing or unreadable, we will fix it or refund you. That is our error, not yours.
- After you download, otherwise. The package is a file, and you have it. We do not refund a correct package because an appeal was unsuccessful, because the deadline was missed, or because the city reached a decision you did not want. We never promised any of those, and a refund tied to an outcome would make this a contingency arrangement, which it is not.
Refunds go back to the card you paid with, and how long they take to appear is your bank’s business rather than ours. Ask at support@phillyappeal.com, with the property address.
There is no subscription to cancel. A payment covers one property for one tax year, and nothing recurs.
Repairing the package, or refunding what you paid for it, is your sole and exclusive remedy for any problem with a package, and is subject to the limit in “Limits on what we owe you” below.
Discount codes
A code reduces the price at checkout. Codes may expire, may be limited in how many times they can be used, and may be withdrawn. A code applies to one appeal, and the price you paid is the price you paid: codes cannot be applied afterwards. Codes have no cash value and cannot be exchanged for one.
Availability
This is software, and software has outages. We do not guarantee that the service will be available at any particular moment, which is a reason not to leave your appeal until the last day. The city’s blank forms are free and published on its own site, so you are never dependent on us to file.
The service is provided as it is
We build and check the calculation with care. Even so, the service is provided “as is” and “as available”, without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. You supply the figures, you review the package, and you sign and file it. We are not responsible for the outcome of any appeal, including an assessment that does not change or that changes in a direction you did not want. Some jurisdictions do not allow certain exclusions, so parts of this may not apply to you.
Limits on what we owe you
To the maximum extent permitted by law, our total liability arising out of or relating to this service or these terms, whether in contract, in tort including negligence, or otherwise, will not exceed the amount you paid us for the package at issue. This limit is an agreed allocation of risk between us and applies even if a remedy set out here fails of its essential purpose.
Nothing in these terms limits liability that cannot lawfully be limited.
Indemnification
You agree to indemnify and hold harmless Philly Appeal and the people who run it from any claim, loss or expense, including reasonable legal fees, arising from your use of the service, the figures you enter, your filing or your failure to file, or your breach of these terms.
Our content
The website, the software and the layout of the calculation worksheet are ours and are protected by law. The package you buy is licensed to you for your own filing: use it, print it, file it, keep it. Do not resell or redistribute the service or its output.
The Board of Revision of Taxes’s blank forms are public documents belonging to the city. We fill them in; we claim nothing over them, and you can download them free from the city yourself.
Governing law and where disputes are heard
These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules. Any dispute must be brought exclusively in the state or federal courts located in Philadelphia County, Pennsylvania, and you consent to their jurisdiction. That is also where the property is, where the city sits, and where the service operates.
The rest of the small print
- Severability. If any part of these terms is held unenforceable, the rest stays in effect.
- Entire agreement. These terms and the Privacy Policy are the whole agreement between us about the service.
- No waiver. If we do not enforce a provision on one occasion, we have not given it up.
- Assignment. You may not assign these terms. We may assign them to a successor of the business.
- Events outside our control. We are not liable for delay or failure caused by something beyond our reasonable control. Because one of those things could happen in the week your appeal is due, do not leave filing until the last day.
Changes to these terms
If these terms change materially, the date below changes with them. Continuing to use the service after that means you accept the revised version.
